These Terms of Use ("Terms") constitute a legally binding agreement between you ("User" or "you") and the MOCHI platform ("we," "us," or "the Platform"). These Terms govern your access to and use of the MOCHI website, mobile application, and all related services (collectively, the "Services").
By accessing or using MOCHI, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please immediately cease using our Services.

1. Account Management and Eligibility
Age Requirement: You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use our Services. If you are under 18, you must have the consent of a parent or legal guardian.
Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Accounts are personal and non-transferable.
Service Integrity: We strive for 24/7 availability but do not guarantee uninterrupted service. We reserve the right to modify, suspend, or terminate Services or your account at our discretion, especially in cases of policy violations.
Assumption of Risk: You use the Platform at your own risk. We are not liable for AI-generated outputs that are inaccurate, unexpected, or offensive, nor for any consequences arising from system errors or data loss.
2. Purchases, Subscriptions, and Virtual Currency
Payments: All fees are processed through authorized third-party payment providers (e.g., Apple App Store, Google Play). Prices are subject to change based on market conditions.
Virtual Currency: "Bone" and "Bone Shards" are virtual tokens used exclusively within MOCHI for premium features. They have no cash value, are non-refundable, and cannot be transferred between accounts.
Subscriptions: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing cycle through your device settings.
Expiration: Purchased "Bones" do not expire. However, promotional or bonus "Bones" tied to a specific subscription period will expire at the end of that cycle.
Refund Policy: Unless required by local law, all purchases are final and non-refundable.
3. AI-Generated Content (AI-GC)
Ownership: MOCHI does not claim ownership or copyright over content generated by the AI based on your prompts. You are free to use such content, provided it complies with these Terms and applicable laws.
Nature of AI: You acknowledge that AI outputs are generated by machine learning and may be incomplete, inaccurate, or unpredictable.
No Professional Advice: AI-generated content is for entertainment and creative purposes only. It should not be relied upon for medical, legal, financial, or professional advice.
Restrictions: You may not use MOCHI to generate content that is illegal, pornographic, violent, or infringes on third-party rights.
4. User-Uploaded Content and Licensing
User Responsibility: You are solely responsible for any data, images, or text you upload. You warrant that you own or have the necessary licenses for such content.
License Grant: By uploading content, you grant MOCHI a worldwide, royalty-free, non-exclusive, sublicensable license to store, display, and use your content to provide and improve the Services.
Public Content: If you choose to share your content publicly, you grant other users the right to interact with, adapt, or remix that content within the Platform.
Removal Rights: We reserve the right to remove any user content that violates public order, morality, or these Terms without prior notice.
5. Acceptable Use Policy
You agree not to:
Reverse engineer, decompile, or attempt to extract the source code of the Platform.
Use automated systems (bots, scrapers) to access the Services without authorization.
Upload malware, viruses, or any code designed to disrupt the Platform's operations.
Impersonate others or engage in fraudulent activities.
Infringe upon the intellectual property or privacy of others.
6. Disclaimers and Limitation of Liability
"As-Is" Basis: The Services are provided "as-is" and "as-available." We disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.
Liability Cap: To the maximum extent permitted by law, MOCHI shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits or data.
Indemnity: You agree to indemnify and hold MOCHI and its affiliates harmless from any claims, losses, or legal fees arising from your use of the Services or violation of these Terms.
7. Third-Party Platform Terms
If you access MOCHI via the Apple App Store or Google Play, you are also bound by their respective terms. You acknowledge that these Terms are between you and us, not the app store providers.
8. General Provisions
Modifications: We may update these Terms from time to time. Continued use of the Services after such changes constitutes your acceptance of the new Terms.
Severability: If any provision of these Terms is found to be invalid, the remaining provisions will continue in full force and effect.
Governing Language: In the event of any discrepancy between the English version and any translated version, the English version shall prevail.
